Fall 2010 Althing Ballot - 2010/08/24 01:57 Fall 2010 Imperial Althing Ballot

Ballots are due to Prime Minister Korderellin by 11:59 PM on Friday, September 17th. Ballots must be submitted in their entirety directly from your own e-mail address to Korderellin(at)gmail.com, or to your local PM. who must submit the ballots by the specified end time. You must be voter eligible and in a taxes-paid core province in order to vote.

Althing Proposals:


1. Edit Appendix B with numerous changes.

It is proposed to re-write Appendix B as follows:
"In the event that an individual should be caught and/or proven guilty of any of the following acts:

• Assault with a deadly weapon (gun, knife, sword, etc.),
• Possession or trafficking of narcotics,
• Or any other mundanely felony-equivalent offense,

on the premises of any Amtgard function or in relation to Amtgard, the individual shall be punished accordingly at the discretion of the monarch. Suggested penalties include:

• Being banned from all Amtgard battlegame, tourney and quest participation for a minimum duration of (one) year, to permanently (subject to Monarch’s discretion AND Althing vote),
• Being immediately requested to leave the site of the Event,
• Being stripped immediately of all titles of Nobility and Knighthood belts,
• Being subject to an immediate call to the mundane law enforcement officials (police or sheriff ).

In the event that an individual should be caught, and/or proven guilty of any of the following acts:

• Assault with a non-deadly weapon (fist, stick, flagrant abuse of an Amtgard Weapon),
• Petty theft,
• Willful destruction of property,
• or any other mundanely misdemeanor-equivalent offense,

on the premises of any Amtgard function or in relation to Amtgard, the individual shall also be punished accordingly at the discretion of the Monarch. Suggested penalties include:

• Being banned from all Amtgard battlegame, tourney and quest participation for a period of 2 (two) to 6 (six) months,
• Being requested to drop any title of Nobility or Knighthood belt for a period of no less that 6 (six)
months,
• Being subject to an immediate call to the mundane law enforcement officials (police or sheriff).

Any person banned from Amtgard participation, or stripped of titles of Nobility/Knighthood belts, may petition to be reinstated. A petition signed by at least 20% of the active populace of the Empire will be enough to have a vote called at Althing to decide whether or not to reinstate participation privileges or titles/Knighthoods for that individual. A majority of at least two-thirds is necessary for reinstatement. "

Rationale:

There are a number of issues that have cropped up over the years regarding the way Appendix B is written. While it is useful as a means of determining how best to handle a situation in the event that an offense occurs that requires disciplinary action, the implementation of the action is too rigid. The following issues are addressed by this proposal:

A) Currently, under the IM corpora, in order for Appendix B to be enacted appropriately, it requires that some sort of offense occurs specifically at an Amtgard event. The language in the Appendix is being changed to reflect that any offense related to Amtgard is punishable as per the dictates of Appendix B.
Currently, the corpora gives almost no discretion to Monarchs with regard to the punishment that is meted out for an offense. If an offense meets a very basic standard, the monarch is required, by corpora, to enact the punishment exactly as the corpora mandates, with no ability to vary or take into consideration the circumstances or nature of the offense. This proposal allows the Monarch to use their discretion as far the punishment is concerned, and suggests specific punishments as guidelines in case there is some difficulty in determining the most appropriate punishment for a given offense.
C) This proposal removes the clause in the Appendix referring to “Serving alcohol to a minor.” When the Appendix was first added, providing alcohol to a minor was considered a felony offense, and was treated accordingly. Due to changes in the law, this is no longer the case, and requiring a felony level punishment for a non-felony related offense appears overly harsh. The IM has also proven unwilling, as a whole, to mete out punishment for such an offense when it may have occurred.
D) This proposal also allows for those who have had their belts and/or titles stripped under this Appendix to have an opportunity to have those awards re-instated. The same procedures for re-instatement of participation are used for re-instatement of awards.




2. Allow for Pro-tem positions when there are no declarations.
It is proposed to add the following language to 5.A.h, 5.B.h, 5.C.h, 5.D.h, 6.A.f, 6.B.f, 6.C.f, 6.D.g, 7.A.c, 7.B.c, 7.C.c, and 7.D.b:
"… If, upon the end of the declaration period, no other candidates have declared for the office, the incumbent officer can, if desired, declare for an additional term as a pro-tem officer if he or she has already met the two consecutive term limit. "

Rationale: Currently, if there is no one else willing to take a necessary position, the officer currently holding that position is ineligible to be considered a candidate if they have already held the position for two consecutive terms. This proposal allows for them to take office again only so long as there is no one else willing to step up and take the office instead. If another candidate steps up, then the incumbent officer is still ineligible to step into office if the two term limit has been reached.



3. Remove Taxation
It is proposed to remove sections 3.E and 3.F in their entirety, remove the statement “Provincial donations need not be forwarded to the Empire and are not taxed in any way” from section 3.D, and remove “and payment of taxes to the Empire” from 7.B.i, 7.C.h, and 7.D.g.

Rationale: Taxes are a waste of space in the corpora. Not a single group in the IM core is currently taxes paid, and repeated attempts to request funds from the provinces have received no response. There is no point having a section in the corpora that we have proven incapable of enforcing, and that the provinces have proven unwilling to follow.

Re:Fall 2010 Althing Ballot - 2010/08/31 02:42 As required by the IM corpora, there will be a sit-down althing to discuss the proposals on 9/11/2010, after Dragonmaster, at Kord and Casca's house. If you are voter eligible, please attempt to make it to the discussion so you can hear arguments for and against the issues in question. Emperor Kota will chair the discussion. Casca Eruoy - 8 yes, no abstains. Casca is elected to office.

Proposal #1: 6 Yes, 1 no, 1 abstain. Proposal #1 passes.
Proposal #2: 7 yes, 1 abstain. Proposal #2 passes.
Proposal #3: 8 yes, 0 no, 0 abstain. Proposal #3 passes.
